Publit Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "Customer," or "User") and Midwest Design Lab LLC, doing business as Publit ("Publit," "Company," "we," "us," or "our"), governing your access to and use of the Publit platform, including our website located at https://publit.app, any related subdomains, applications, software, and services (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
We may update or modify these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after any changes become effective constitutes your acceptance of the updated Terms.
1. The Publit Platform
Publit is a hosted software-as-a-service (SaaS) platform that enables users to:
- A. Build and publish personal websites, including static or dynamic public pages; and
- B. Build, manage, and publish directories or resource hubs, which may include listings, records, or pages intended for public discovery ("Directories").
Publit provides the technical infrastructure only. Users control what content is created, published, and made public.
2. Eligibility and Accounts
You must be at least 18 years old to use the Services. By registering, you represent that you have the authority to enter into this agreement on behalf of yourself or an entity.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Subscriptions, Trials, and Billing
Paid Subscriptions
Publit is a paid SaaS product. Access to features depends on your selected subscription tier.
Trials
From time to time, we may offer limited trials or promotional access. Trials may convert to paid subscriptions unless canceled before the trial ends.
Enterprise Plans
Enterprise or custom plans may be governed by a separate written agreement, which will control in the event of a conflict.
Billing and Renewals
Subscriptions renew automatically unless canceled before the end of the current billing period. Fees are non-refundable except where required by law.
4. User Content and Public Pages
Ownership
You retain ownership of all content you submit, upload, or publish through the Services ("User Content").
License to Publit
You grant Publit a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and otherwise process User Content solely as necessary to operate, maintain, support, and improve the Services.
Access for Service Operations
To operate, maintain, support, secure, and improve the Services, authorized Publit personnel may access user accounts, User Content, and related technical or usage information where reasonably necessary for legitimate business purposes, including customer support, troubleshooting, service optimization, and platform integrity. Publit does not access user passwords or full payment credentials, which are handled by secure third-party providers.
Public Visibility
You acknowledge that:
- Websites and Directories created with Publit may be publicly accessible;
- Content may be indexed by search engines;
- Administrators are not publicly identified unless they choose to include identifying information.
Publit is not responsible for how third parties access or use public content.
5. Directory-Specific Responsibilities
If you create or manage a Directory, you represent and warrant that:
- You have the right to publish any listed information;
- Any personal data included was collected and published lawfully;
- You will honor requests for correction or removal when legally required.
Publit does not verify directory accuracy and is not responsible for directory content.
6. Acceptable Use
You agree not to:
- Use the Services for unlawful, deceptive, or harmful purposes;
- Publish content that infringes intellectual property or privacy rights;
- Scrape, reverse engineer, or interfere with the Services;
- Use the Services to compete directly with Publit.
We reserve the right to suspend or terminate accounts for violations.
7. Intellectual Property
Publit retains all rights to the platform, software, designs, and trademarks. No rights are granted except as expressly stated.
8. Third-Party Services
The Services may integrate with third-party tools (e.g., payments, analytics). Publit is not responsible for third-party services.
9. Termination
You may cancel your subscription at any time. We may suspend or terminate access for violations, non-payment, or legal compliance.
10. Disclaimers
The Services are provided "as is" and "as available." Publit disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Publit shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the six (6) months preceding the claim.
12. Indemnification
You agree to indemnify and hold Publit harmless from claims arising from your use of the Services or User Content.
13. Governing Law and Dispute Resolution
These Terms are governed by Indiana law. Any disputes shall be resolved through binding arbitration in Marion County, Indiana, except where prohibited by law.
